1. Agreement to these terms
Complete Blackout Blinds is a business operating under the assumed name or DBA “Complete Blackout Blinds” (“Complete Blackout Blinds,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) apply to your use of completeblackoutblinds.com and its forms, content, and related website features.
By accessing or using the website, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the website.
2. Website information
The website provides general information about blackout window coverings, consultations, professional measurement, and installation services. Website content is provided for informational and marketing purposes and is not a binding offer, construction specification, guarantee, or substitute for an on-site assessment.
We try to keep the website accurate and useful, but product descriptions, photographs, illustrations, comparisons, colors, features, service areas, availability, lead times, and other content may be approximate or change without notice. Display settings and lighting may affect how colors and materials appear.
3. Consultations and estimates
Submitting a consultation request does not require you to purchase and does not require us to accept a project. We may need to inspect and measure the window, confirm property and installation conditions, verify service availability, and discuss your goals before recommending a product.
Any preliminary website statement, telephone discussion, or informal estimate is subject to confirmation. A project becomes binding only when the parties accept a separate written proposal, order, or service agreement. If that agreement conflicts with these website Terms regarding the project, the signed or otherwise accepted project agreement controls.
4. Custom products and installation
Many blackout systems are manufactured or prepared for a particular opening. Final dimensions, mounting method, controls, materials, colors, hardware, price, deposit, payment schedule, estimated delivery, installation scope, change orders, cancellation rights, returns, and warranty terms will be stated in the applicable written proposal or customer agreement.
Installation eligibility can depend on window construction, trim, depth, squareness, access, hidden utilities, building rules, lease restrictions, and other site conditions. Renters and property managers are responsible for obtaining any required owner or association approval unless a written agreement expressly assigns that responsibility to us.
5. Blackout performance and product expectations
Results depend on the selected product, window opening, glass, trim, surrounding construction, installation method, room surfaces, and the intensity and direction of outside light. “Blackout,” “complete blackout,” and similar descriptions refer to the intended light-control purpose of an appropriate product and installation; they do not guarantee that every room will be absolutely free of all visible light under every condition.
Thermal comfort, noise softening, sleep quality, privacy, and other benefits also vary by room and product. Unless included in a written agreement or manufacturer warranty, website statements about these benefits are not performance guarantees.
6. Health and safety information
Website information about sleep, nurseries, light sensitivity, migraines, comfort, or wellness is general information only and is not medical advice, diagnosis, or treatment. Consult an appropriate healthcare professional about medical concerns.
Follow all product instructions and safety guidance, including guidance concerning children, pets, cords, controls, mounting hardware, heat sources, emergency egress, and operation. Do not alter, remove, or repair installed components unless authorized or qualified to do so.
7. Communications and information you submit
You agree that the information you submit is accurate to the best of your knowledge and that you have authority to provide it. You authorize us to respond using the contact information and communication preferences you provide. Marketing communications remain subject to the choices described in our Privacy Policy and applicable law.
Do not submit unlawful content or highly sensitive information such as Social Security numbers, financial-account credentials, or medical records through a general consultation form.
8. Acceptable website use
You may use the website only for lawful personal or business purposes related to learning about or requesting our services. You may not interfere with website operation or security; attempt unauthorized access; introduce malware or automated abuse; impersonate another person; collect information about other users; submit fraudulent requests; or use website content in a way that violates law or another person’s rights.
9. Intellectual property
The website’s original text, design, layout, graphics, photographs, branding, and other content are owned by or licensed to Complete Blackout Blinds and are protected by applicable intellectual-property laws. You may view and print reasonable portions for personal, noncommercial evaluation of our services. No other reproduction, modification, distribution, publication, scraping, or commercial use is authorized without prior written permission.
Product names, trademarks, photographs, and other materials belonging to manufacturers or third parties remain the property of their respective owners.
10. Third-party websites and services
The website may link to or rely on third-party services. We do not control and are not responsible for their content, availability, security, products, terms, or privacy practices. A link does not necessarily mean we endorse every statement, product, or service on the linked website.
11. Website availability and disclaimers
The website is provided on an “as available” basis. To the extent permitted by law, we disclaim implied warranties relating solely to website access and website content, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the website will always be available, uninterrupted, secure, or error-free.
These website disclaimers do not replace or limit any express written product or workmanship warranty included in an accepted customer agreement, and they do not waive rights that cannot lawfully be waived.
12. Limitation of liability
To the extent permitted by law, Complete Blackout Blinds will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of, or inability to use, the website. Any liability relating to a purchased product or installation service will be governed by the applicable customer agreement, written warranty, and non-waivable law.
Nothing in these Terms excludes liability or consumer remedies that cannot be excluded under applicable law.
13. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where another law must apply. Any dispute concerning only the website or these Terms will be brought in a court with lawful jurisdiction in Texas, unless the parties agree to another lawful resolution process.
14. Changes, severability, and waiver
We may update these Terms as the website, services, or law changes. The “Last updated” date identifies the current version. Continued use of the website after revised Terms are posted means the revised Terms apply to later website use.
If any provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. Our failure to enforce a provision once does not waive our right to enforce it later.
